These Terms of Use govern your use of Leaves.com (the “Site”), which is owned and operated by Top Notch Domains, LLC (“we,” “us,” or “our”). By using the Site, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the Site.

What the Site is

Leaves.com offers general information for planning fall foliage trips: estimated color timing and conditions for places in the lower 48 states, destination guides, and a guide to common trees and their fall color. The Site is free to use and doesn’t require an account.

Estimates, not guarantees

Everything on the Site about foliage timing and conditions, including peak dates, color stages, viewing scores, elevations, and outlooks, is an estimate produced by a model of typical years. It is not based on live observations of this year’s conditions. Actual color can arrive earlier or later, be brighter or duller, or end sooner than shown because of weather, drought, freezes, storms, local conditions, and many other factors.

You are responsible for checking current conditions before you travel. We are not responsible for travel, lodging, or other costs, missed peak color, or any other loss that results from relying on the Site.

How the Site was created

The Site, including its text, illustrations, code, and forecast model, was created with substantial use of artificial intelligence (AI) tools. AI-generated material can contain errors, omissions, and statements that sound confident but are wrong. We review what we publish, but the Site’s content has not necessarily been reviewed by professional foresters, botanists, meteorologists, or other experts, and we do not guarantee that any of it is accurate, complete, or current. Treat it as a starting point, not an authority.

Outdoor safety and plant identification

Viewing fall foliage can involve driving mountain roads, hiking, changing weather, and other risks. You are solely responsible for your own safety and the safety of anyone traveling with you, and for following all laws, park rules, road closures, and private property restrictions.

The leaf guide is for general interest only. Do not rely on it to decide whether a plant is safe to touch, eat, or use for any purpose. Some plants shown on the Site, such as poison ivy, can cause serious skin reactions.

Acceptable use

You may use the Site for your own personal, non-commercial trip planning. You agree not to:

Scrape, crawl, or bulk-download the Site, or systematically extract its data, including its location data and forecast results, except that search engines and AI assistants may access the Site as permitted by our robots.txt file.
Use automated tools to send large numbers of requests or otherwise place an unreasonable load on the Site.
Republish, resell, or commercially use the Site’s data or forecast results, or use them to build a competing product or service.
Frame or mirror the Site, or present its content as your own.
Interfere with the Site’s operation or security, or try to gain unauthorized access to any system connected to it.
Use the Leaves.com name or logo in a way that suggests we are affiliated with, sponsor, or endorse you or your product.
Use the Site for any unlawful purpose.

We may block access to the Site by anyone we believe is violating these Terms, at our sole discretion and without notice.

Third-party software, services, and links

Some software and map data used on the Site come from third parties and are provided under their own licenses, which are listed in our licenses file. Those licenses govern those components. The Site also relies on third-party services, such as StatCounter for visitor statistics and Google Fonts for typefaces, and may link to other websites. We don’t control and aren’t responsible for third-party services, websites, or their content.

Feedback

If you send us suggestions, corrections, or other feedback, we may use it for any purpose without any obligation or payment to you.

Changes to the Site and these Terms

We may change, suspend, or discontinue any part of the Site at any time without notice. We may also update these Terms by posting a new version on this page with a new effective date. Your continued use of the Site after an update means you accept the updated Terms.

Disclaimer of warranties

THE SITE AND ALL OF ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF ACCURACY, RELIABILITY, AVAILABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TOP NOTCH DOMAINS, LLC AND ITS OWNERS, MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, OR ANY TRAVEL OR LODGING COSTS, ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED FIFTY U.S. DOLLARS ($50).

Some jurisdictions don’t allow certain of these exclusions or limits, so some of them may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless Top Notch Domains, LLC and its owners, members, managers, employees, and agents from any claims, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of your use of the Site or your violation of these Terms.

Disputes

These Terms are governed by the laws of the State of New Hampshire, without regard to its conflict-of-laws rules. Any dispute arising out of or related to the Site or these Terms must be brought exclusively in the state or federal courts located in New Hampshire, and you consent to their jurisdiction. To the fullest extent permitted by law, any claim must be brought on an individual basis and not as part of a class or representative action, you waive any right to a jury trial, and any claim must be filed within one year after it arose or it is permanently barred.

General

These Terms and our Privacy Policy are the entire agreement between you and us about the Site. If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any part of these Terms is not a waiver. We may transfer our rights and obligations under these Terms, including in connection with a sale of the Site or its domain name; you may not transfer yours.
